Alice,

 

Here are the Constitution sections that apply to your city hall fight. The first one debunks the current court rulings that have sprung up all over America saying AMERICAN CITIZENS do not have STANDING to bring Barack Hussein Obama to justice for not obeying the US Constitution and proving that he is a Natural Born Citizen. It also covers your situation where you are running for Justice of the Peace in Douglas, Arizona against a Mexican-National who is not qualified to run for any office in the United States, Arizona or any city thereof.

 

US CONSTITUTION

Article III

Section 1. The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour, and shall, at stated Times, receive for their Services, a Compensation, which shall not be diminished during their Continuance in Office.

Section 2. The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority;--to all Cases affecting Ambassadors, other public Ministers and Consuls;--to all Cases of admiralty and maritime Jurisdiction;--to Controversies to which the United States shall be a Party;--to Controversies between two or more States;--between a State and Citizens of another State;--between Citizens of different States;--between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects.

As you can see you have a constitutional right as a US CITIZEN to have “controversies” heard in any ‘inferior court” (Sec 1) in the United States. Section 2 clearly states that a citizen of the US has a right to sue citizens of a foreign state (Mexico).

 

If you will view the Preamble of the Constitution, it starts out with the words “WE THE PEOPLE OF THE UNITED STATES…” This first sentences shows that all elected officers and officials MUST BE THE SAME…THEY MUST BE WE THE PEOPLE OF THE UNITED STATES. It does not say We The People of Mexico, or Canada, or the World…but THE UNITED STATES.

 

Likewise, your Arizona Constitution states: “We the people of the State of Arizona, grateful to Almighty God for our liberties, do ordain this Constitution.”

 

Again, it refers to WE THE PEOPLE OF ARIZONA…meaning all must be CITIZENS!

Your constitution further validates your rights by saying:

 

2. Political power; purpose of government

Section 2. All political power is inherent in the people, and governments derive their just powers from the consent of the governed, and are established to protect and maintain individual rights.”

 

Sec 13 also talks about the rights of citizens…

 

Section 21 states all elections must be FREE AND EQUAL…

 

It is not free and equal when non-citizens from another country come in and run for office…You are at a disadvantage if you have to follow the law and the rules and your opponent does not.

 

It is amazing to me that most of your state does not follow Section 35:

 

“35. Actions by illegal aliens prohibited”

 

“Section 35. A person who is present in this state in violation of federal immigration law related to improper entry by an alien shall not be awarded punitive damages in any action in any court in this state.”

 

Article IV

 

2. Qualifications of members of legislature

Section 2. No person shall be a member of the Legislature unless he shall be a citizen of the United States at the time of his election, nor unless he shall be at least twenty-five years of age, and shall have been a resident of Arizona at least three years and of the county from which he is elected at least one year before his election.

 

Article V

 

2. Eligibility to state offices

Section 2. No person shall be eligible to any of the offices mentioned in section 1 of this article except a person of the age of not less than twenty-five years, who shall have been for ten years next preceding his election a citizen of the United States, and for five years next preceding his election a citizen of Arizona.

 

10. Canvass of election returns for state officers; certificates of election

Section 10. The returns of the election for all state officers shall be canvassed, and

certificates of election issued by the secretary of state, in such manner as may be

provided by law.

 

14. Superior court; original jurisdiction

Section 14. The superior court shall have original jurisdiction of:

Your state Constitution seems to agree that the powers of Congress are “To establish a uniform Rule of Naturalization” but it is the STATE/COUNTY that has jurisdiction of the citizenship of the people within their state!

 

Article VI

 

26. Oath of office

Section 26. Each justice, judge and justice of the peace shall, before entering upon the duties of his office, take and subscribe an oath that he will support the Constitution of the United States and the Constitution of the State of Arizona, and that he will faithfully and impartially discharge the duties of his office to the best of his ability.

 

The oath of all judges of courts inferior to the superior court and the oath of justices of the peace shall be filed in the office of the county recorder, and the oath of all other justices and judges shall be filed in the office of the secretary of state.

Article VII

 

2. Qualifications of voters; disqualification

Section 2. A. No person shall be entitled to vote at any general election, or for any office that now is, or hereafter may be, elective by the people, or upon any question which may be submitted to a vote of the people, unless such person be a citizen of the United States of the age of eighteen years or over, and shall have resided in the state for the period of time preceding such election as prescribed by law, provided that qualifications for voters at a general election for the purpose of electing presidential electors shall be as prescribed by law. The word "citizen" shall include persons of the male and female sex.

 

B. The rights of citizens of the United States to vote and hold office shall not be denied or abridged by the state, or any political division or municipality thereof, on account of sex, and the right to register, to vote and to hold office under any law now in effect, or which may hereafter be enacted, is hereby extended to, and conferred upon males and females alike.

 

C. No person who is adjudicated an incapacitated person shall be qualified to vote at any election, nor shall any person convicted of treason or felony, be qualified to vote at any election unless restored to civil rights.

 

You can plainly see that your Arizona Constitution in (B) above states that the RIGHTS OF CITIZENS OF THE UNITED STATES TO VOTE AND HOLD OFFICE… upholds your contention that ONLY citizens can hold office of any sort.

 

Article XVIII

10. Employment of aliens

Section 10. No person not a citizen or ward of the United States shall be employed upon or in connection with any state, county or municipal works or employment; provided, that nothing herein shall be construed to prevent the working of prisoners by the state or by any county or municipality thereof on street or road work or other public work and that the provisions of this section shall not apply to the employment of any teacher, instructor, or professor authorized to teach in the United States under the teacher exchange program as provided by federal statutes enacted by the congress of the United States or the employment of university or college faculty members. The legislature shall enact laws for the enforcement and shall provide for the punishment of any violation of this section.

 

Wow! I cannot believe you have this in your State Constitution yet the city of Douglas (AZ) has an illegal alien serving as a JUSTICE OF THE PEACE. I wish California had a similar Constitutional law, but if they ignored it like Arizona seems too, then it wouldn’t do much good.

 

This would, of course, make it illegal for Barry Soetoro (a.k.a. Barack Obama) to hold any state, county or municipal employment in your State. Since he is not a US Citizen (his mom wasn’t old enough to transfer citizenship to him in 1961) and especially holds true if he was indeed a citizen of Indonesia (and never got reapplied for citizenship).

 

My next email will rip into Soetoro about his shady “Natural Born Citizen” legislation…and his deceit to the American people.
